  • Confidential Information: All information and data that is provided to Castillo Realty LLC and its website by clients or third parties that is not publicly known, and that relates to a client’s engagement or its affairs.   • Castillo Realty LLC acts on instructions from clients when using Confidential and Personal Information. These instructions may be given orally or in writing, and their form and detail depend on both the services and the client’s wishes or requirements.
  • Castillo Realty LLC may use certain Confidential and Personal Information if authorized for statistical purposes, industry and market analysis, according to the corresponding field. Castillo Realty LLC will be responsible for anonymizing the information and protecting the client.
  • Although not a common feature for the delivery of services, Castillo Realty LLC complies with any customer requirements or restrictions on the use of Personal Information to profile or make automated decisions about individuals. 

RETENTION

  • Castillo Realty LLC provides client with the facility to access and delete Confidential and Personal Information processed on client’s behalf, client is responsible for deleting Confidential and Personal Information when it is no longer needed. Castillo Realty LLC will delete Confidential and Personal Information at the end of any retention period agreed with the client, or in accordance with the client’s instructions.
  • Castillo Realty LLC may retain copies of Confidential and Personal Information to comply with legal requirements or for compliance or record-keeping purposes, in which case Castillo Realty LLC will retain such Confidential and Personal Information for as long as required by those legal requirements or to fulfill those purposes.
  • With respect to Confidential and Personal Information maintained in backup copies or archives, Castillo Realty LLC operates a scheduled destruction cycle, and selective deletion is not feasible.

DISCLOSURE

    • Confidential and Personal Information is shared within Castillo Realty LLC with those individuals and departments who need to know. Disclosure depends on the nature of the information and the services being delivered.
    • Castillo Realty LLC will only disclose confidential information to outside organizations in the course or for the purpose of providing services to clients and may also disclose to third parties when required by law or for compliance purposes.

  • If permitted by law and regulation, Castillo Realty LLC shall inform the relevant client or third party where it proposes to disclose Confidential or Personal Information as required by law or to respond to a government request.

EXERCISE OF RIGHTS

  • In the event that a person other than a client wishes to exercise any rights (such as of access or correction) under applicable privacy laws as regards Personal Information, CASTILLO REALTY LLC will promptly notify the client so that the client can respond.
  • If CASTILLO REALTY LLC receives a complaint about the collection, use or sharing of Personal Information or a request from a regulatory authority responsible for compliance with privacy laws, CASTILLO REALTY LLC will, to the extent permitted by law, promptly notify the client so that the client can respond.

SAFEGUARDS

  • Castillo Realty LLC collects, uses, maintains, shares (internally and externally), and destroys Personal Information in a manner that appropriately limits the risk of loss, theft, misuse, or unauthorized access.

HOW WE RESPOND TO CCPA REQUESTS

We respond to all requests we receive from individuals wishing to exercise their consumer privacy rights in accordance with applicable consumer privacy laws. If your request is subject to the CCPA, within 10 days of receiving your request, we will confirm that we received it and explain to you how we will process it, including any further information we may need.
